Early repayment: what the law says

A borrower may, on the occasion of an unexpected reopening of money for example, decide to reimburse, before the end of his contract, part or all of his loan. The loan contract can provide compensation for this early repayment. This refund must also have a minimum value.

The borrower can always reimburse everything in advance of the loan. The lender is entitled to compensation that can not exceed the value of one semester of interest on the capital repaid, without being able to exceed 3% of the remaining capital due (article R. 312-21 of the consumer code). The credit agreement can prohibit flat repayments or less than 10% of the initial amount of the loan, except if it is the balance.
For contracts concluded after June 30, 1999, no compensation is due when the reimbursement is motivated by the sale of the real estate in response to a change of place of professional activity, death or forced cessation of the professional activity of the borrower or your spouse.  »

When the borrower reimburses the consumer credit in advance, interest and expenses corresponding to the residual duration of the credit agreement are not due.
An indemnity may be due to the borrower who wishes to reimburse his consumer credit in advance except in specific cases determined by law (article L. 311-22 of the consumer code). No compensation can be claimed in the following cases:

For overdraft authorizations
If the early repayment is made in execution of an insurance contract to guarantee the repayment of the credit
If the early repayment intervenes in a period when the debtor rate is not fixed
If the credit is a revolving credit.
The refund in advance can not be used in case of rental with purchase option (article L.311-22-1 of the same code).
In other cases, when the amount of the early repayment is greater than 10 000 euros, the lender can demand compensation that can not exceed 1% of the amount of the credit that is subject to the early repayment if the period between the early repayment and the date The end of the credit agreement is greater than one year. If the term does not exceed one year, the compensation can not exceed 0, 5% of the amount of the credit that is subject to the early repayment.
In all cases, the eventual compensation due to the lender can not exceed the amount of interest that the borrower would have paid during the period between the early repayment and the date of termination of the credit agreement initially agreed.
